The legal basis for data processing is Art. 6 para. 1 lit. b GDPR, which permits the processing of data for the performance of a contract or pre-contractual measures.

4. ANALYSIS TOOLS AND ADVERTISING

GOOGLE ANALYTICS

This website uses functions of the web analytics service Google Analytics. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics uses so-called "cookies." These are text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is generally transmitted to and stored on a Google server in the USA.

The storage of Google Analytics cookies is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its website and its advertising.

IP ANONYMIZATION

We have activated the IP anonymization function on this website. This means that your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

BROWSER PLUGIN

You can prevent the storage of cookies by adjusting your browser settings; however, please note that in this case you may not be able to fully utilize all the functions of this website. Furthermore, you can prevent Google from collecting and processing data generated by the cookie and related to your use of the website (including your IP address) by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

OBJECTION TO DATA COLLECTION

You can prevent Google Analytics from collecting your data by clicking on the following link. This will set an opt-out cookie that prevents the collection of your data on future visits to this website: Disable Google Analytics.

For more information on how Google Analytics handles user data, please see Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.

ORDER DATA PROCESSING

We have concluded a data processing agreement with Google and fully implement the strict requirements of the Swiss data protection authorities when using Google Analytics.

Demographic characteristics in Google Analytics

This website uses the "demographic characteristics" feature of Google Analytics. This allows reports to be generated that contain information about the age, gender, and interests of website visitors. This data comes from Google's interest-based advertising and from third-party visitor data. This data cannot be attributed to any specific individual. You can deactivate this feature at any time via the ad settings in your Google account or generally prohibit the collection of your data by Google Analytics as described in the section "Objection to data collection".

GOOGLE ANALYTICS REMARKETING

Our websites use the features of Google Analytics Remarketing in conjunction with the cross-device functions of Google AdWords and Google DoubleClick. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

This feature allows you to link advertising audiences created with Google Analytics Remarketing to the cross-device features of Google AdWords and Google DoubleClick. This way, interest-based, personalized advertising messages, tailored to you based on your previous usage and browsing behavior on one device (e.g., mobile phone), can also be displayed on another of your devices (e.g., tablet or PC).

If you have given your consent, Google will link your web and app browsing history to your Google account for this purpose. This allows the same personalized advertising messages to be displayed on any device where you sign in with your Google account.

To support this function, Google Analytics collects Google-authenticated user IDs, which are temporarily linked to our Google Analytics data to define and create audiences for cross-device advertising.

You can permanently opt out of cross-device remarketing/targeting by disabling personalized advertising in your Google account; follow this link: https://www.google.com/settings/ads/onweb/.

The aggregation of collected data in your Google account is based solely on your consent, which you can grant or withdraw at Google (Art. 6 para. 1 lit. a GDPR). For data collection processes that are not aggregated in your Google account (e.g., because you do not have a Google account or have objected to aggregation), the data collection is based on Art. 6 para. 1 lit. f GDPR. The legitimate interest arises from the fact that the website operator has an interest in the anonymized analysis of website visitors for advertising purposes.

Further information and the data protection regulations can be found in Google's privacy policy at: https://www.google.com/policies/technologies/ads/.

GOOGLE ADWORDS AND GOOGLE CONVERSION TRACKING

This website uses Google AdWords. AdWords is an online advertising program of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (“Google”).

We use conversion tracking as part of Google AdWords. When you click on an ad served by Google, a conversion tracking cookie is set. Cookies are small text files that your web browser stores on your computer. These cookies expire after 30 days and are not used to personally identify users. If you visit certain pages of this website and the cookie has not yet expired, Google and we can recognize that you clicked on the ad and were redirected to this page.

Each Google AdWords customer receives a different cookie. These cookies cannot be tracked across the websites of different AdWords customers. The information collected using the conversion cookie is used to generate conversion statistics for AdWords customers who have opted in to conversion tracking. Customers see the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can personally identify users. If you do not wish to participate in tracking, you can easily disable the Google conversion tracking cookie in your browser's user settings. You will then not be included in the conversion tracking statistics.

The storage of “conversion cookies” is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its website and its advertising.

For more information about Google AdWords and Google Conversion Tracking, please see Google's privacy policy: https://www.google.de/policies/privacy/.

You can configure your browser to notify you when cookies are set and to allow cookies only in individual cases, to accept cookies in certain cases or to generally reject them, and to automatically delete cookies when you close your browser. Disabling cookies may limit the functionality of this website.

PANDECTES GDPR

We use the Pandectes GDPR Compliance app (provided by Pandectes, Greece) on our website to obtain and document your consent to the use of cookies and similar technologies in accordance with data protection law.

Purpose of processing
Pandectes enables us to use cookies, analytics, and marketing tools on our website in compliance with legal requirements. A cookie consent banner allows you to decide which categories of cookies you permit (e.g., necessary, statistics, marketing). Your selection is documented and stored in a cookie.

What data does Pandectes process?

  • Your consent decision (acceptance or rejection)

  • Timestamp of consent

  • IP address (anonymized or shortened)

  • Information about the browser and device used

  • Cookie ID (for recognition on return visits)

Legal basis
The processing is based on your consent in accordance with Art. 6 of the revised German Data Protection Act (and – where applicable – analogously to Art. 6 para. 1 lit. a of the GDPR). The storage of technically necessary cookies occurs independently of your consent, as they are required for the display of the website.

Storage duration
The consent data will be stored for [e.g., 12 months] or until you reset your cookie settings via the banner. You can withdraw or adjust your consent at any time via the "Cookie settings" link at the bottom of the page.

Data processing by third parties
The data is processed via Pandectes servers. According to the provider, the data servers are located in the EU. Pandectes is committed to complying with all relevant data protection regulations.

Further information can be found in Pandectes' privacy policy. .

7. General Principles

7.1 What data do we collect from you and from whom do we receive this data?
We primarily process personal data that you provide to us or that we collect when you use our website. We may also receive personal data about you from third parties. This could include the following categories:
  • Personal data (name, address, date of birth, etc.);
  • Contact details (mobile phone number, email address, etc.);
  • Financial data (e.g., account details);
  • Online identifiers (e.g., cookie identifiers, IP addresses);
  • Location and traffic data;
  • Audio and video recordings;
  • particularly sensitive data (e.g. biometric data or information about your health).
7.2 Under what conditions do we process your data?
We process your data in good faith and in accordance with the purposes set out in this privacy policy. We ensure transparent and proportionate processing.
Should we exceptionally be unable to comply with these principles, data processing may still be lawful because a legal justification exists. A possible legal justification includes, in particular:
  • Your consent;
  • the performance of a contract or pre-contractual measures;
  • our legitimate interests, unless your interests override them.
7.3 How can you withdraw your consent?
If you have given us your consent to process your personal data for specific purposes, we will process your data within the scope of this consent, unless we have another legal basis for doing so.
You can withdraw your consent at any time by sending an email to the address listed in the legal notice. This does not affect data processing that has already taken place.
7.4 In which cases can we share your data with third parties?

a. principle

We may need to use the services of third parties or affiliated companies and commission them to process your data (so-called data processors). Categories of recipients include, in particular:
  • Accounting, trust and auditing firms;
  • Consulting firms (legal advice, taxes, etc.);
  • IT service providers (web hosting, support, cloud services, website design, etc.);
  • Payment service providers (only with your prior consent);
  • Providers of tracking, conversion and advertising services (only with your prior consent).
We ensure that data is only shared with your explicit consent, unless it involves commissioned data processing. Furthermore, we ensure that these third parties and our affiliated companies comply with data protection regulations and treat your personal data confidentially.
Under certain circumstances, we may also be obliged to disclose your personal data to authorities.

b. Disclosure to partners and cooperation companies

We sometimes work with different companies and partners who display their offers on our website. You will be able to see that these are third-party offers (marked as "advertising").
If you take advantage of such an offer, we will transmit your personal data (e.g., name, position, contact details, etc.) to the relevant partner or cooperating company whose offer you wish to use, provided you have given your explicit consent beforehand. These partners and cooperating companies are independently responsible for the personal data they receive. After the data has been transmitted, the data protection regulations of the respective partner apply.

c. Visit our social media channels

We have embedded links to our social media channels on our website. These are clearly visible to you (typically via corresponding icons). Clicking on the icons will redirect you to our social media channels.
In this case, the social media providers will learn that you are accessing their platform from our website. The social media providers can use the data collected in this way for their own purposes. Please note that we have no knowledge of the content of the transmitted data or how it is used by the operators.

d. Transfer abroad
In some cases, your personal data may be transferred to companies abroad as part of order processing. These companies are bound by the same data protection obligations as we are. This transfer may occur worldwide.
If the level of data protection does not correspond to that of Switzerland, we will conduct a prior risk assessment and contractually ensure that the same level of protection as in Switzerland is guaranteed (e.g., by means of the EU Commission's new Standard Contractual Clauses or other legally required measures). Should our risk assessment be negative, we will implement additional technical measures to protect your data. You can access the EU Commission's Standard Contractual Clauses at the following link:
7.5 How long do we keep your data?
We only store personal data for as long as is necessary to fulfill the individual purposes for which the data was collected.
Data we collect when you visit our website is stored for twelve months. An exception applies to analytics and tracking data, which may be stored for a longer period.
We store contract data for longer periods because we are legally obligated to do so. In particular, we must retain business correspondence, concluded contracts, and booking documents for up to 10 years. If we no longer require such data from you to provide services, the data will be blocked and used only for accounting and tax purposes.
7.6 How do we protect your data?
We will keep your data secure and take all reasonable measures to protect your data from loss, access, misuse or alteration.
Our contractual partners and employees who have access to your data are obligated to comply with data protection regulations. In some cases, it will be necessary for us to forward your inquiries to affiliated companies. Even in these cases, your data will be treated confidentially.
Within our website, we use the SSL (Secure Socket Layer) protocol in conjunction with the highest level of encryption supported by your browser.
7.8 What rights do you have?

a. Right to information
You can request information about the data we have stored about you at any time. Please send your request, along with proof of identity, to info@mollerus.com .
You also have the right to receive your data in a commonly used file format if we process your data automatically, and if
  • You have given your consent to the processing of this data; or
  • You have disclosed data in connection with the conclusion or execution of a contract.
We may restrict or refuse to provide information or data if this conflicts with our legal obligations, legitimate interests of our own or public interests, or the interests of a third party.
Your application will be processed within the statutory processing time of 30 days. However, we may extend this period due to a high volume of inquiries, for legal or technical reasons, or because we require further information from you. You will be informed of any extension in a timely manner, at least in writing.

b. Deletion and correction
You have the right to request the deletion or correction of your data at any time. We may reject your request if legal regulations require us to retain the data for a longer period or in its original form, or if a legal basis for processing your data precludes your request.
Please note that exercising your rights may conflict with contractual agreements and have corresponding effects on the performance of the contract (e.g., premature termination of the contract or cost consequences).

c. Legal recourse
If you are affected by the processing of your personal data, you have the right to enforce your rights in court or to file a complaint with the competent supervisory authority. The competent supervisory authority in Switzerland is the Federal Data Protection and Information Commissioner.
